For those of you who “don’t really care” about politics, I would like to remind you that this is why elections matter, unless you support the decision *glances at E, Dave, and probably DFV*, in which case I want you to remember how bad the GOP field is, so stay home in 2008. 🙂

For those of you who just love the crazy, be sure to read Justice Thomas’ “Get off of my lawn you damn kids” concurrence.

I guess we will just let the strict constructionists explain their position on this one. Apparently the founders were in favor of every kind of speech except those that got in the way of government aims. If Larry Flynt’s case went to the court right now, he would be a convict.

My support for Roberts and Alito was yet another instance in which I was little more than a useful idiot.

  1. A. I couldn’t be happier. When you are a high schooler you have to live by the rules of the schools. The right to be an idiot is not yours to exercise until you are an adult.

    B. George Bush may not be so bright on occasion, but his Supreme Court justices that made it onto the court are great.

    C. The kids an idiot. What a dork.

    D. I hope Thomas is on the court until he is 98 just to piss of the Left.

    E. Maybe there is just the slightest hope for the public school system. The fact that a public school administrator even raised a finger in this particular instance is a frickin’ miracle.

  3. Free speech, as long as I agree… This is a scary place we are heading. Justices Alito and Kennedy said they didn’t like it, and would have dissented, but the whole “drug” thing, as well as a lack of political theme, pushed them into the majority.

    That is just fucking NUTS!

    We can now regulate speech based entirely on content, and you approve? Really?

  4. Absolutely. A chump teenager can’t get a tattoo or their ears pierced without a parent’s consent and can even get grounded for an entire weekend. What a crime against humanity. School is like the army, they’ve got you and you just can’t do whatever you want whenever you want. Simple concept. I may be a child of the eighties;you could carry a knife to school but you’d get beat down for a stupid stunt like this and no one would have ever dreamed of crying and sniveling all the way to the Supreme Court about it. And for the champions of the concept of Political Correctness to bemoan this decision is probably the biggest hypocritical stance I have ever seen in my life. Common sense is buried beneath such idiocy and child like mentality. Apparently personal responsibility, decency, self-respect and self-control no longer exist in society. What a shame. p>

  5. So I guess the idea of “Free Speech Zones” on college campuses now appeals to you, as well.

    It’s state owned land, many of the kids are teenagers there on their parents’ dime.

    Oh wait… These kids were of school property. Maybe not a good example.

    Still, how about limiting “Free speech” to the Plaza. Are you now a fan of this?

    Or does one year make a difference between what Jefferson wrote, and what he really meant?

  6. It’s the simple difference between a child and an adult. High school and beyond that. I’m surpised this is so hard for everyone. Arguing common sense and basic responsible behavior is actually tiring and amazingly frustrating.

    But yeah, it’s a real case, and he was suspended for wearing it. The Courts rightly overturned that decision. Was the court wrong? Or was this just another silly kid?

  9. I’m not sure if Andre realizes this but public schools are technically responsible for students from doorway to doorway. Like it or not, when kids engage in nefarious behaviors after school such as drinking, drug use or fighting, schools still have jurisdiction to punish and in some cases aid in the prosecution of those behaviors.
    This case is so limited in its scope that it has no effect whatsoever on the day to day free speech rights of anyone reading this post. It involves the ability of our public school systems to silence the objectionable speech of the students put in their charge. I too cheer the decision as one against the use of the courts to advance whatever legal itch some punk ass kid and his financial backers feel they can use to make a point.
    We as educators restrict the speech of our students all the time in various venues related to the school. This just affirms that ability.

  10. One good example of what I am saying is the increased use of My Space and YouTube as vehicles for students to express themselves. We know that kids videotape fights or photograph themselves with firearms, for example, and have faced suspension or expulsion from school for doing so even though those things had nothing to do with school. Andre apparently believes that these actions by administration is “fucking nuts.” The world that is charged with educating and protecting kids disagrees.

    One thing strikes me about that case:

    What a frickin douchebag the kid and his parents were for bringing that case before a judge. Similarly, kids and their parents that bring cases of pro or anti Santa, or Bong hits 4 Jesus signs before our Courts are also douchebags. These parents believe that they are setting a good example for little Johnny when in actuality they are clogging the courts and wasting people’s time.

  14. lol apparently thinks kids can do whatever they want on school time. And true to the mold of a young leftist know-nothing, he makes his points without a shred of evidence or a rational argument. Is lol suggesting that students can make statements about pot on field trips? At what point in the school day can students not make statements about pot? I guess we’ll never know because “lol” just likes to ejaculate a profane name without making a real point.

    LOL has obviously slipped out of his room and gotten onto his dad’s computer. Saving up a week’s supply of his Ritalin pays off on a friday night, and the practice he gets at pretending to swallow whilst surreptitiously spitting will serve him well in his future career on the corner of Main and 12th street.
